Chapter 3 Response to Armed Attack

Section 1 Communication of Information Regarding Indications of Armed Attack

   Where information is received indicating a possible armed attack, MLIT will promptly communicate this information to the Government Response Headquarters (Cabinet secretary) in the manner separately determined.
   Where information is received indicating a possible armed attack, in addition to immediately securing the required lines of communication for information transfer, MLIT will without delay confirm the safety of its facilities and collect information such as damage assessments.

Section 2 Establishment of Action Systems

 1.  Cooperation with the Armed Attack Response Headquarters
 
   Where as stipulated under the Armed Attack Response Policy ("the Response Policy") the Government Response Headquarters has been established, MLIT will cooperate with this headquarters in promoting the establishment of citizens' protection measures.
   Where the Government Response Headquarters has been established, the Minister of Land, Infrastructure and Transport will attend as a member of the Armed Attack Response Headquarters. In addition MLIT will dispatch personnel as required to the Government Response Headquarters.
   Where notified by the Head of the Government Response Headquarters that this Headquarters has been established, based upon the type of alert issued, MLIT will immediately contact the managers of the regional bureaus and designated public bodies under its control.
   Where an On-Site Armed Attack Response Headquarters has been established, MLIT will dispatch personnel as required.

 2.  Establishment of MLIT Armed Attack Response Headquarters
 
(1) Establishment of MLIT Armed Attack Response Headquarters
 
   Where the Government Response Headquarters has been established and when required for the comprehensive implementation of measures such as citizens' protection measures, MLIT will immediately establish the MLIT Armed Attack Response Headquarters ("the Ministry Response Headquarters") headed by the Minister of Land, Infrastructure and Transport.
   The Ministry Response Headquarters will perform coordination, information collection, collation and communication activities within the Ministry in respect of citizens' protection measures and similar, as well as all other necessary liaison activities such as information sharing and dissemination.
   Where the Ministry Response Headquarters has been established, it will make contact with concerned bodies such as the Government Response Headquarters, regional bureaus, concerned ministries and agencies and designated public bodies under its control.
   The Ministry Response Headquarters, dependent on the type of armed attack, will strengthen required operations implementation systems.
   In addition to the matters outlined in this plan, items related to its operation such as the organization of the Ministry Response Headquarters and the order of appointment to positions will be determined separately.
(2) Establishment of Regional Bureau Response Headquarters
 
   Where the Ministry Response Headquarters has been established and when required for the implementation of citizens' protection measures or similar within MLIT authority, regional bureaus organized along the same lines as the Ministry Response Headquarters ("Regional Bureau Response Headquarters") will be established.
   Where a Regional Bureau Response Headquarters has been established, this will be immediately communicated to the Ministry Response Headquarters.

 3.  Information Collection and Reports
 
(1) Information Collection and Reports
 
   MLIT will promptly collect information regarding the status of citizens' protection measures implementation, damage assessment of facilities under its control and other information related to an armed attack within its area of operations. The Ministry Response Headquarters will then collate this information and report to the Government Response Headquarters as required.
   In addition to collecting information about the circumstances of an armed attack from the Government Response Headquarters, the Ministry Response Headquarters will also collect information related to implementation of citizens' protection measures by designated public bodies and share this information within the Ministry.
(2) Securing Communication Systems
 
   In the event of an armed attack, in addition to immediately confirming whether the required means of communication are functioning, MLIT will secure the lines of communication required to contact concerned bodies.
   To secure the means of communication required to implement citizens' protection measures, MLIT will put in place the measures required for the emergency repairs or reconstruction of damaged communication facilities and in addition will immediately provide a damage assessment to the Ministry of International Affairs and Communications.
   Where the means of communication required to implement citizens' protection measures have been damaged or there is a power outage due to an armed attack, MLIT will secure the required backup communication systems to ensure safety and will also promptly perform emergency repairs or reconstruction.

 4.  Implementation of Emergency Call-Ups
 
   To promptly implement the appropriate citizens' protection measures, MLIT will, as required, perform an emergency call-up of concerned personnel in accordance with the separately determined procedures.

Section 3 Ensuring Safety

   When implementing citizens' protection measures, taking into account the substance of those measures, MLIT will give full consideration to ensuring the safety of its staff and those persons' involved in implementing the measures while also providing necessary information such as the type of armed attack, cooperating with concerned bodies and establishing backup emergency communication systems.
   To ensure that citizens' protection measures are safely implemented, MLIT will as required issue and ensure the use of special stamps and personal identification as stipulated under Article 158.1 of the Citizens' Protection Law in accordance with the separately determined procedures.

Section 4 Cooperation With Concerned Bodies

   MLIT will closely cooperate with concerned bodies such as the Government Response Headquarters, concerned ministries and agencies, local public authorities and designated public bodies when implementing the appropriate citizens' protection measures.
   Where a municipal or prefectural Governor has made a request for citizens' protection measures to be implemented, giving due respect of the underlying purpose of the request, MLIT will, as required, promptly implement those measures.

Section 5 Providing Information to Citizens

   In addition to cooperating with the Government Response Headquarters, MLIT will provide to the citizens in an appropriate and timely manner information such as the status of implementation of citizens' protection measures and damage to facilities under its control through methods such as publication in the news media and posting on the MLIT website.
   MLIT will provide information to aircraft crews.
   MLIT will request that the Travel Industry Association provide information to Japanese travelers who are overseas on organized tours.

Section 6 Issue and Transmission of Alerts

   Where an alert is issued by the Government Response Headquarters, in addition to promptly and reliably issuing this alert to the heads of regional bureaus and designated public bodies under its control, MLIT will also communicate this alert to the managers of major facilities under its control and aircraft crews in accordance with the separately determined procedures.
   The procedures for issuing and transmitting cancellation of an alert will be the same as for issuing and transmitting an alert.

Section 7 Evacuation and Relief Measures

 1.  Issue and Transmission of Evacuation Directives
 
   Where an evacuation measures directive has been issued by the Government Response Headquarters, in the same manner as an alert issue and transmission, MLIT will issue these directives to the heads of regional bureaus, designated public bodies under its control and aircraft crews. The procedures for issuing a directive canceling evacuation measures will be the same.

 2.  Support of Evacuation and Relief
 
   Where an evacuation crosses over municipal or prefectural boarders and consultations will be held regarding the acceptance of evacuees and in-transit support between the municipality or prefecture from which the people are to be evacuated, the municipality or prefecture to which they will be evacuated and any municipality or prefecture that the evacuation route passes through, MLIT will participate in those talks as required.
   Where a facility under MLIT control has been designated in advance as an evacuation facility by a municipal or prefectural Governor and where it will accept evacuees, MLIT will take the necessary measures to open that evacuation facility.
   Where relief support is requested by a municipal or prefectural Governor, MLIT will give the required support, including providing relief supplies and information on the availability of supply routes, dispatch of personnel with expertise in this area and requests for the cooperation of administrators under MLIT control.
   Where a municipal or prefectural Governor has requested support for the construction of emergency temporary housing or similar, MLIT will provide that support as required.

Section 8 Ensuring the Safety and Appropriate Management of Facilities Under MLIT Control

 1.  Ensuring the Safety of Facilities Vital to Everyday Life
 
   MLIT will promptly implement safety measures in respect of facilities vital to everyday life that are under its control such as the strengthening of patrols and security.
   Where MLIT will implement safety measures in respect of facilities vital to everyday life, it will as required request the support and advice of agencies such as the municipal and prefectural police departments, the Fire and Disaster Management Agency and the Japan Coast Guard in matters such as the provision of materials, equipment and personnel.
   Where a crisis is imminent or an emergency response is required over a wide geographical area and there is no time to wait for a request from a municipal or prefectural Governor, after promptly seeking the opinion of the National Police Agency and the Japan Coast Guard, MLIT will request that the managers of facilities vital to everyday life under its control take the required safety measures and will notify the concerned municipal or prefectural Governors.
   Where a request has been made to implement safety measures in respect of facilities vital to everyday life under its control, MLIT will give full consideration to ensuring the safety of managers or other persons employed at those facilities by providing in a timely manner the information required for these people to safely and appropriately implement those safety measures. In addition the same will apply to the implementation of safety measures for facilities vital to everyday life managed by the MLIT itself.
   In the event of an armed attack to a facility vital to everyday life under its control, MLIT will promptly take the appropriate measures to prevent further damage, such as providing instructions and advice to the manager of that facility, supplying materials and equipment, dispatching personnel and contacting concerned bodies.
   Where a request has been made from the manager of a facility vital to everyday life under its control, MLIT will provide the required support to ensure its safety, such as providing instructions and advice, supplying materials and equipment and dispatching personnel.
Further even where there has been no request for support, where it deems it necessary, MLIT will provide support to a facility vital to everyday life under its control.

 2.  Ensuring the Safety of Facilities Under MLIT Control Other Than Those Vital to Everyday Life
 
   MLIT will implement required safety measures, such as the strengthening of security and patrols in line with the particular characteristics of each facility not vital to everyday life that it manages.
   In respect of facilities not vital to everyday life that it doesn't manage, MLIT will provide instructions and advice on the required safety measures such as strengthening security and patrols in line with the particular characteristics of each facility.

Section 9 Securing Transport

 1.  Requests for Transport
 
(1) Requests for Transport of Emergency Supplies
 
   MLIT will request that designated public bodies that are transport administrators transport emergency supplies as required. However where Article 12.1 of the Road Use Guidelines (Law Concerning the Use of Designated Public Facilities in the Event of an Armed Attack (No.114 of 2004. "Designated Public Facilities Use Law" Road Use Guidelines) applies an appropriate request for transport that takes into account those guidelines will be made.
   Where a request for transport of emergency supplies is made to a designated public body that is a transport administrator, MLIT will give full consideration to ensuring the safety of that body and its personnel by providing it with the required information so that the transport can be performed appropriately and safely.
(2) Support of Transport Requests
 
   Where a request is received from the head of a designated local or national government body or a local public authority for support in the transport of evacuees or emergency supplies, MLIT will provide the required support such as liaison and coordination activities.
   To ensure transport of evacuees or emergency supplies proceeds smoothly at the time of transport, MLIT will flexibly apply the related laws and ordinances to simplify and speed up authorization procedures.
   Where it is necessary to evacuate citizens from remote islands, in addition to providing support in determining the condition of aircraft and vessels and performing liaison and coordination activities with transport administrators, MLIT will also provide support to secure the required the aircraft, vessels, airfields and port and harbor facilities necessary for the evacuation when requested by the head of a local public authority.
   Where the evacuation of citizens off the main island or other remote islands in Okinawa Prefecture is required, MLIT will take into account the following considerations.
 
 ·  In cooperation with Okinawa Prefecture, in addition to requests to local or national government bodies that are transport administrators of sea and air routes to and from Okinawa, to ensure priority in securing the aircraft, vessels, airfields and port and harbor facilities necessary for evacuation, MLIT will also request that these bodies implement the necessary measures to ensure that the transport of evacuees proceeds smoothly.
 ·  Where evacuation from the prefecture is required, MLIT will provide support to ensure the availability of airfields and port and harbor facilities at the evacuation destination as well as the means of transportation.
(3) Miscellaneous
 
   Where a request has been made by the head of the Ministry of Health, Labour and Welfare, the Ministry of Education, Culture, Sports, Science and Technology, a designated public body (National Hospital Organization, Japan Red Cross Society) or local public authority for the emergency transport of medical teams (teams comprising doctors, nurses, mid-wives, etc.) to an affected area or transport of people from these areas to medical facilities, MLIT will give priority to ensuring their means of transport and will also liaise and cooperate with transport administrators in these activities.

 2.  Securing Alternative Transport
 
   For ports, harbors and airports that are the hubs of international and arterial transportation, MLIT will develop acceptance systems that include operational logistics so as to be able to shift travelers and goods to other areas and other modes of transport. In addition MLIT will introduce support measures to ensure the availability of alternative transport.
   To ensure that transport is convenient for citizens in affected areas, from the viewpoint of maintaining a national transport system, in addition to cooperating with concerned ministries, agencies and local public authorities, MLIT will also perform coordination activities and provide instructions to transport operators as required to ensure the smooth introduction of alternative transport.

Section 10 Traffic Control

   MLIT will provide the support required for road administrators to take necessary measures such as road closures and in addition will cooperate with metropolitan and prefectural police to ensure that citizens are promptly advised of the current circumstances.
   In addition to giving priority to the takeoff and landing of aircraft engaged in information collection, evacuee transportation or implementation of other citizens' protection measures, in matters such as providing information to other carriers that use airspace specified under the use guidelines set forth in Article 15.1 of the Specified Public Facilities Use Law, MLIT will perform air traffic control taking into account both these use guidelines and the citizens' protection measures.

Section 11 Response to Nuclear Disaster Due to Armed Attacks

   Where a report is received of a nuclear disaster due to an armed attack during transport, MLIT will immediately contact the Nuclear Safety Commission and the Government Response Headquarters.
   MLIT will as required cooperate in the collection and analysis of information gathered at the site by the dispatched Nuclear Safety Commission and other experts.
   In respect of a nuclear disaster due to an armed attack that has occurred during transport, MLIT will compile the information received from the nuclear facility operator regarding any leak of radioactive materials and the monitoring results communicated by the local public authorities and will immediately contact the concerned designated government bodies, the concerned local public authorities and the Government Response Headquarters.
   In respect of other emergency responses to nuclear disaster due to an armed attack, MLIT will act in accordance with the Disaster Prevention Plan (Nuclear Disaster Countermeasures Edition) and the MLIT Disaster Operations Plan (Nuclear Disaster Countermeasures Edition).

Section 12 Collection of Citizens' Status Information

   Where information is collected concerning a person's status or provided by an administrator or operator under its control, such as whether a person is an evacuee or has been killed or injured in an armed attack, MLIT will as a general rule provide that information to the head of the local public authority in the area where that person is currently present and also to the head of the local public authority in the area where that person resides if this can be clearly identified and in addition will also cooperate in the collection of information concerning a person's status by the head of a local public authority.
   At the time information concerning a person's status is collected or provided, MLIT will give full consideration to the protection of private information.

Section 13 Cooperation with Citizens

   Where a request is made for citizens' cooperation in the implementation of citizens' protection measures, MLIT will give full consideration to ensuring their safety by providing in a timely manner the appropriate information.
   Where volunteer cooperation is sought, in addition to taking into account the circumstances of an armed attack, MLIT, at the same time as determining the appropriateness of volunteer activities from the viewpoint of volunteer safety, will also ensure the effective utilization of volunteers' skills.
   Based upon the plan for accepting support from overseas drafted by the Government Response Headquarters, MLIT will accept the appropriate support.
