Concerning revision of the enforcement regulations of the Construction Industry Law in regard to adjustments for consignments to public service corporations

1. Content

On March 30, 2001, a ministerial ordinance (Ministry of Land, Infrastructure, Transport and Tourism Ordinance Nr. 72) was promulgated and entered into effect that partially revised the enforcement regulations of laws concerning the prevention of maritime pollution and disasters. Article 2 of the ordinance partially revised the enforcement regulations of the Construction Industry Law. An overview of the revision is provided below. Related notices were adjusted at the same time.
 
(1) The "Standards for Consignment of Surveys to Public Service Corporations" (Cabinet Decision, September 1994) determines the requirements for the nation's assignment of inspections to public service corporations and establishes that public service corporations receiving assignments are specified according to law.
Herein, the public service corporations receiving the assignments stated below are determined by the enforcement regulations of the Construction Industry Law.
 
Assignments
(1) Designated examination institutions for technical examinations defined by Article 27/2, Clause 1, of the Construction Industry Law
(2) Designated qualification certificate issuing institutions defined by Article 27/19, Clause 1, of the Construction Industry Law
(3) Designated management situation analysis institutions defined by Article 27/24, Clause 1, of the Construction Industry Law
 
Recommendations
(1) Inspection and certification of skills or abilities in execution of construction work
(2) Tests and examinations designated by the Minister of LIT and stated in the table in Article 27/7 of the Construction Industry Law Enforcement Regulations
(3) Training designated by the Minister of LIT as specified in Article 27/18, Clause 4, of the Construction Industry Law
(4) Inspection and certification of knowledge of accounting for construction businesses
 
(2) At the same time, in accordance with April 2, 2001 MLIT Notice Nr. 464 (regarding adjustment of the applicable notices following enforcement of the Ministerial Ordinance Partially Revising the Enforcement Regulations of Laws Concerning the Prevention of Maritime Pollution and Disasters), we have rescinded notices that made public the designations of public service organizations.
