Chapter 1 General
|
Section 1 Purpose of the
Plan |
|
Based upon Article 33.1 and Article 182.2
of the Law Concerning Measures for the Protection of Citizens In Respect
of Armed Attack, etc. (Law No. 112 of 2004. "the Citizens' Protection
Law") this plan sets out the items required for MLIT to conduct
supervisory duties to enable it to contribute to the prompt implementation
of appropriate measures to protect citizens in the event of an armed
attack (including both actual and predicted an armed attack) as well
as the response measures for other emergencies. |

Section 2 Basic Principles |
|
Based upon the Citizens' Protection Law,
other applicable laws and ordinances, the Basic Guidelines for the
Protection of Citizens (Cabinet Decision March 25, 2005) and this
plan, in addition to cooperating with citizens and concerned bodies,
MLIT will ensure the prompt implementation of appropriate citizens'
protection measures in areas over which it has authority in the event
of an armed attack. |

Four possible attack scenarios are considered:
1) Ground invasion; 2) Attack by guerillas or commando units; 3)Attack
by ballistic missile; 4) Aerial attack. Further consideration is also
given to the special responses required in the case of a nuclear,
biological or chemical attack (an "NBC attack"). |

When implementing citizens' protection
measures, in addition to taking into account the type of attack as
outlined above, MLIT will pay special attention to the following items. |
1. |
Respect for Basic Human Rights |
|
|
In respect of citizens' protection
measures, MLIT will respect basic human rights and ensure the
measures are implemented in a fair and just manner. Further,
where the measures restrict the freedom or rights of citizens,
they will be limited to the absolute minimum required for their
effective implementation. |

2. |
Prompt Remedies in respect of Citizens'
Rights and Benefits |
|
|
MLIT will ensure that procedures
are in place to ensure prompt remedies in respect of citizens'
rights and benefits. |
|
3. |
Providing Information to Citizens |
|
|
In the event of an armed attack,
in addition to cooperating with all concerned ministries and
agencies, MLIT will provide to the citizens timely, appropriate
and accurate information concerning the status of citizens'
protection measures implementation and the circumstances of
the attack (defined as information regarding the time, place
and location of the attack, outline of the type of attack, number
of casualties and property damage). |

4. |
Ensuring Cooperation with Concerned
Bodies |
|
|
In respect of citizens' protection
measures, MLIT will develop a standing system of cooperation
with concerned bodies. |
|
5. |
Citizens' Cooperation |
|
|
To increase awareness of the importance
of citizens' protection measures, MLIT will obtain the voluntary
cooperation of the citizens. |
|
6. |
Special Considerations regarding Designated
Public Bodies Independence |
|
|
When designated public bodies will
implement citizens' protection measures, MLIT will give full
consideration to independent assessments made by designated
public bodies. |
|
7. |
Considerations regarding the Elderly
and Disabled and Appropriate Implementation of the International Humanitarian
Law |
|
|
When implementing citizens' protection
measures, MLIT will give full consideration to the needs of
the elderly and disabled. |
|
When implementing citizens' protection
measures, in the event of an international armed conflict, MLIT
will ensure that the International Humanitarian Law, as it applies
to such a conflict, is appropriately implemented. |

8. |
Ensuring Safety |
|
|
When implementing citizens' protection
measures, in addition to cooperating with concerned bodies,
MLIT will also take into consideration ensuring the safety of
those people implementing the citizens' protection measures. |
|
9. |
Overall Coordination by the Head of
the Government Response Headquarters |
|
|
Where overall coordination is performed
by the head of the Armed Attack Response Headquarters ("the
Head of the Government Response Headquarters"), MLIT will
as required promptly implement the appropriate measures. |
