 3. ITEMS TO BE NEWLY INCORPORATED IN THE PLAN

On the basis of the opinions of the Administrative Reform Committee, the opinions and wishes concerning feedback on deregulation from both Japan and abroad, 68 items have been newly incorporated into the plan, primarily from the five perspectives listed below.

The items newly incorporated in the plan are as follows.

(1) Revisions in Regulations Which Contribute to Reductions in Distribution Cost

Specific examples are as follows.

Responses to Transport of Multiple Number of Dangerous Articles Transported in Identical Tank Trunks

(Content of Measures)

With regard to tank trucks transporting multiple numbers of dangerous articles for which limits are placed on the type and volume of such articles, studies will be conducted into means of amply ensuring that overloading will not occur, with permission for free combinations of types and volumes within a set sphere. (Implementation schedule: From fiscal 1996.)

Partial Expansion of Coasting area Where Geographical Curvature Results in Vessel Convergence

(Content of Measures)

The operation zone for coastal (not international) shipping vessels,coasting area, is designated in principle as the sea area within 20 nautical miles of the shore. However, for water areas, such as those between Cape Muroto and Cape Ashizuri, where it is impossible to sail in a straight line, regulations will be eased to expand coasting area. (Implementation schedule: Fiscal 1996)

Easing of Transport Regulations on Vehicles on Which Standards Have Been Eased for Transport of Cargo Impossible to Break Down

(Content of Measures)

With regard to the regulations which prevent loading of other cargo onto vehicles on which standards have been eased for the transport of heavy cargo unable to break down during the deadheading of these vehicles, studies will be conducted on the basis of ample consideration for maintaining safety, with measures devised necessary to approve that transport as long as the transport is conducted within the standards of the related legislation. (Implementation schedule: From fiscal 1996 on.)

(2) Revisions in Regulations Which Contribute to Improvement of Passenger Transport Service

Specific examples are as follows.

Easing in Double/Triple Track Standards on Domestic Aviation.

(Content of Measures)

In October 1992

  1. Double-track standards for initial year demand of 700,000 persons or more were eased to 400,000 persons/year or more.

  2. Triple-track standards for initial year demand of one million persons or more were eased to 700,000 persons/year or more.

The latest measure will further ease these standards to one half their current level.

  1. For double-track, annual demand of 200,000 persons or more
    (three daily roundtrips on B737).

  2. For triple-track, annual demand of 350,000 persons or above.
    (five daily roundtrips on B737)

As a result, 20 new routes will be targeted under the triple-track category, and 15 new routes under the double-track category. (Implementation date: April 1, 1996.)

Lowering the Minimum Vehicle Ownership Standard for the Taxi Business

(Content of Measures)

Based on consideration for regional characteristics and with the pivotal focus on Tokyo and other major urban regions, sweeping revisions will be undertaken in the direction of overall deregulation. (Implementation schedule: Fiscal 1996.)

Revisions in Regulations on Rental Bus Business

(Content of Measures)

  • Clarification of supply-demand adjustment inspection standards, and greater operation flexibility. (Implementation schedule: To be gradually implemented from fiscal 1996.)

  • With regard to business zones, gradual expansion to prefectural units as a general rule. (Implementation schedule: To be gradually implemented from fiscal 1996.)

  • With regard to the minimum vehicle ownership regulation, sweeping revisions will be undertaken in the direction of overall deregulation. (Implementation schedule: Fiscal 1996.)

Easing of Owner-Driver Taxi Entry Regulations

(Content of Measures)

With regard to owner-driver taxis, the following measures will be devised from the perspective of maintaining fairness and transparency.

  • Based on the conditions in specific regions, steady expansion will be made in the regions in which licenses are supplied. (Implementation schedule: To be gradually implemented from fiscal 1996.)

  • With regard to geography tests, revisions will be made in the content of the questions (which will be limited to the sphere necessary for actual operation), while studies will be conducted into public disclosure of question content, minimum passing scores and other areas. (Implementation schedule: Fiscal 1996.)

(3) Revisions in Regulations Which Contribute to the Maintaining of International Transport Competitive Strength

Specific examples are as follows.

Easing of Maximum Flight Time Limitation for Extended Range Operation with Twin-Engine Airplane (ETOPS)

(Content of Measures)

With regard to the maximum flight time limitation for ETPOS (the limitation of maximum flight time to the closest airport at which a landing can be made form any point on the route with regard to a twinengine airplane), one of the conditions for air transport service, studies will be made of the current regulations of other countries, the record of ETOPS, the required flight crew training and so forth. As a result of the studies, if no safety problem is found, the limitation will be eased. (Implementation schedule: Fiscal 1997.)

Revisions of the Approval of Route Qualification of Pilot-in-Command of an Aircraft used for a Scheduled Air Transport Service

(Content of Measures)

With regard to the approval of route qualification of pilot-in-command of an aircraft used for a scheduled air transport service required for each route, studies will be made of the current regulations of other countries, the equired flight crew training and so forth. As a result of the studies, if no safety problem is found, the revisions wil be carried out.

Facilitating Vessel Cook Qualification by Non-Japanese Crew Members

(Content of Measures)

Measures will be devised necessary to facilitate the obtaining of vessel cook qualification by non-Japanese crew members, through English-language testing and other means. (Implementation schedule: Fiscal 1996.)

(4) Revisions in Regulations Which Contribute to Harmonization with International Standards

Specific examples are as follows.

Establishment of Legal Provision, etc. Toward Accession to Mutual Recognition Agreement Concerning Motor Vehicle Equipment and Parts(Revised United Nation ECE 1958 Agreement).

(Content of Measures)

In order to further improve access to the motor vehicle market, with regard to motor vehicle equipment and parts which has been tested in other countries and confirmed to comply with standards, efforts will be made to establish related legal provision, etc. in order to recognize mutual use without retesting in Japan, submission of data or other steps. (Implementation schedule: From fiscal 1996.)

Standards and Certification Isssues of Japan-U.S. Trade Talks on Automobiles and Auto Parts

(Content of Measures)

As stated in the final document of the Japan-U.S. Trade Talks on Automobiles and Auto Parts, within nine months of the date of the conclusion (August 23, 1995), the expert consultations in the area of standards and certification between Japan and U.S. will be held and necessary measures concerning the areas on which conclusions are reached will be taken.(Implementation schedule: Obtain conclusions by May 1996, implement them thereafter.)

Revision of Definition of Dissassembling Repair

(Content of Measures)

By general review of the definition of disassembling repair, the part which the inspection conducted by government is not required will be expanded. (Implementation schedule: August 1996, items concluded in Japan-U.S. Trade Talks Automobiles and Auto Parts.)

(5) Revisions in Regulations Which Contribute to Improving the Convenience of the National Lifestyle

Specific examples are as follows.

Review of Motor Vehicle Inspections, Checks and Maintenance

(Content of Measures)

Concerning the motor vehicle inspection system, comprehensieve review of the relationship between inspection, checks and maintenance in designated garages will be examined, and through this examination MOT will take the necessary measures. In the examination, MOT will review the requirement that cheks and maintenance have to be done in the same garage in advance when a designated garage conducts inspection, and will take the necessary measures.

  • Promotion will be made to introduce and proliferate by the end of fiscal 1996 a service at a designated garage under which, a check of similar in type to the inspection, on the occasion of checks, will be used to enable users to obtain information, prior to the maintenace, on whether or not a motor vihicle will pass the inspection. This will make it possible for user select on their own responsibility the contents of the maintenance service, using the such information thereby reducing the user burden. (Implementation schedule: Fiscal 1996.)

  • With regard to designated garages, MOT will review a requirement that checks, maintenance and inspection have to be done in the same garage, By the end of fiscal 1996, MOT wil take a measure to make designated garages which don't have their own inspection facilities be able to inspect at the site of another designated garages.

With regard to motor vehicle check and inspection items, a system will be established to carry out reviews through a transparent process. (Implementation schedule: Fiscal 1996.)

Sale of Promotion Trip Products at Convenience Stores, etc.

(Content of Measures)

With regard to the sale of promotion trip products by convenience stores and other businesses, studies will be conducted with consideration for the occurrence of trouble and other problems. (Implementation schedule: From fiscal 1996 on.)

Elimination of Notification for Setting and Changing Fares on Ski-Use Gondolas, etc.

(Content of Measures)

Of normal type cableways, the notification required for setting and chnging fares on ski-use gondolas, etc. will be eliminated. (Implementation schedule: From fiscal 1996 on.)
