Concerning the registration system for construction businesses

1. Concerning application for registration for supervising engineer training

Article 26, Section 4, of the Construction Industry Law specifies that a person who wishes to become a regular supervising engineer for public works must participate in a seminar that is registered with the Minister of Land, Infrastructure, Transport and Tourism. The reason for this is that, from the standpoint of attempting to guarantee reasonable conduct of public works funded by taxpayers, a regular supervising engineer must have a high level of understanding concerning work execution techniques and supervision and knowledge of recent changes in these areas. Previously, seminars for supervising engineers have been administered by designated seminar institutions; however, beginning March 1, 2004, they have been administered by institutions registered after examination by the Minister of Land, Infrastructure, Transport and Tourism.
In order to be able to conduct examinations as a registered examination institution, an institution must conduct the application procedure in accordance with the "application guidelines for registration of supervising engineer training," have an examination by the Minister of Land, Infrastructure, Transport and Tourism to determine if it meets the specified requirements, and be registered.
The "application guidelines" for the corresponding registration system are distributed by the Construction Business Section, General Policies Bureau, Ministry of Land, Infrastructure, Transport and Tourism.
Persons who wish to receive the guidelines by mail should apply by sending a letter including a return envelope (A4, with recipient's address and a stamp attached) to the Construction Business Section, General Policies Bureau, Ministry of Land, Infrastructure, Transport and Tourism.

2. Concerning application for registration as a Management Situation Analysis Institution

Construction business operators who wish to accept public construction work directly from a contracting organization must receive a management matters examination as set forth in Article 27, Section 23, of the Construction Industry Law. The management matters examination numerically rates the management situation and management scale. Previously, the analysis of management situation required herein was undertaken by designated management analysis institutions. Beginning on March 1, 2004, this work has been undertaken by registered management analysis institutions who have been examined by the Minister of Land, Infrastructure, Transport and Tourism.
In order to conduct management situation analyses as a registered management situation analysis institution, an institution must conduct the application procedure in accordance with the "application guidelines for the registration as a registered management situation analysis institution," have an examination by the Minister of Land, Infrastructure, Transport and Tourism to determine if it meets the specified requirements, and be registered.
The "application guidelines" for the corresponding registration system are distributed by the Construction Business Section, General Policies Bureau, Ministry of Land, Infrastructure, Transport and Tourism.

Additionally, in accordance with changes to the tax system in 2005, a registered license tax of 90,000 JPY will apply beginning April 1, 2005 for registration of supervising engineer training or as a registered management situation analysis institution.
 

3. Concerning application to register as a registered accountant examination

In order to produce sound development of construction business operators, it is essential to improve business management skills through the use of reasonable cost accounting and accounting processes. On the other hand, individuals responsible for financial affairs/accounting are required to have even higher levels of expertise because the construction industry is an industry where work is conducted as ordered, and there are many special points that must be considered in regard to accounting documentation. Therefore, beginning on April 1, 2006, the Ministry of Land, Infrastructure, Transport and Tourism began to register exams related to construction business accounting that fulfill specified requirements, and persons who pass the registered exams have their construction business accounting skills rated in accordance with the applicable scoring of the management matters examination established in the Construction Industry Law.
In order to conduct the work of administering exams for registered accountants as a registered accountant examination institution, an institution must conduct the application procedure in accordance with the "application guidelines for registration as a registered accountant examination institution," have an examination by the Minister of Land, Infrastructure, Transport and Tourism to determine if it meets the specified requirements, and be registered.
The "application guidelines" for the corresponding registration system are distributed by the Construction Business Section, General Policies Bureau, Ministry of Land, Infrastructure, Transport and Tourism.

4. Concerning application to register as a registered landslide prevention worker examination

Construction business operators must place a regularly employed engineer who has certain qualifications or experience related to conduct of construction work in each business office. The requirements for regularly employed engineers in general construction businesses are set forth in Article 7, Nr. 2, of the Construction Industry Law and Article 7-3 of the Construction Industry Law Enforcement Regulations.
Beginning on April 1, 2006, the Ministry of Land, Infrastructure, Transport and Tourism has registered exams to verify the skills and knowledge necessary for landslide prevention work and to certify persons who have passed the registered exam and have at least one year of work experience in the field of public engineering or well drilling as a regular engineer for business offices.
In order to conduct the work of administering exams as a registered examination institution, an institution must conduct the application procedure, have an examination by the Minister of Land, Infrastructure, Transport and Tourism to determine if it meets the specified requirements, and be registered.

5. Concerning application to register as a registered instrumentation examination

Construction business operators must place a regularly employed engineer who has certain qualifications or experience related to conduct of construction work in each business office in accordance with Article 7, Nr. 2, of the Construction Industry Law.
Beginning on April 1, 2006, the Minister of Land, Infrastructure, Transport and Tourism has registered exams to verify the knowledge and skills required for work to install and maintain survey instruments, control instruments, and the like in buildings and other structures. Individuals who pass the exams and have more than one year of work experience in the field of electrical work or pipework are recognized as regular engineers in a business office.
In order to conduct the work of administering exams as a registered examination institution, an institution must conduct the application procedure, have an examination by the Minister of Land, Infrastructure, Transport and Tourism to determine if it meets the specified requirements, and be registered.

6. Concerning application to register training/exams for technical supervisors of disassembly/demolition work

Demolition work operators must assign a person to technically supervise the execution of demolition work at construction sites in accordance with the laws related to reprocessing of the materials of construction work (Construction Recycling Law).
Beginning on March 28, 2006, the Ministry of Land, Infrastructure, Transport and Tourism has certified persons with specific education and experience and who have taken courses registered with the Minister of Land, Infrastructure, Transport and Tourism as technical supervisors.
In order to conduct training as a registered training institution or administration of exams as a registered examination institution, an institution must conduct the application procedure, have an examination by the Ministry of Land, Infrastructure, Transport and Tourism to determine if it meets the specified requirements, and be registered.
