Abstract of the Port and Harbor Law

Article 1: In order to contribute to the development of transportation, appropriate use of national lands, and equitable development, this law addresses the orderly development of ports and harbors, their appropriate management, and the development and maintenance of navigation channels, with consideration for the maintenance of the environment.

Article 3, Item (2): The Minister of Land, Infrastructure and Transport must establish the basic guidelines related to the development, use, and maintenance of ports and harbors and the development of navigation channels to be developed and. preserved.

Article 3, Item (3): The port management bodies of major ports must formulate plans (port plans) related to the items set forth in ordinances related to development, use, and maintenance of ports and harbors.

(4) Once port plans are formulated and/or modified, the port management bodies of major ports must, without delay, submit said port plan to the Minister of Land, Infrastructure and Transport.

Article 4: A regional public entity that currently manages the port facilities at said port, or a regional public entity which formerly established, maintained, or managed port facilities at said port, or a regional public entity which has in its purview a land area whose offshore water surface is a planned port zone, may on its own or in cooperation with others, set up articles of incorporation, and establish a Ports and Harbors Bureau.

Article 33: At ports with no established port authority, a relevant local public entity may itself become a port management body, or establish a local public entity as a port management body pursuant to the Local Autonomy Act, Chapter 284, Item 2 or Item 3.

Article 42: When a port management body at a major port performs major construction work for the construction or improvement of marine facilities, outlying facilities, or berthing facilities, with the goal of offering them for the use of the general public, the burden of expenses for that construction shall be shared equally by the national government and the port management body.

Article 43: In cases other than those stipulated in the previous Article, the national government may assist port management bodies according to a uniform standard and within budgetary limits, with the expenses for port construction whose goal is use by the general public, when said assistance is deemed to be particularly necessary.

Article 52: In cases in which it is necessary at major ports to increase the convenience of transportation in general, prevent the occurrence of pollution, improve the environment, or to increase the convenience of general transport at harbors of refuge, when the national government and the port management body have successfully completed negotiations, the Minster of Land, Infrastructure and Transport may, within budgetary limits, approve the construction him/herself.

(2) Of the expenses incurred in port construction that the Minister of Land, Infrastructure and Transport undertakes according to the stipulations of the previous Article, a fixed percentage of those associated with the construction or improvement of fixed facilities shall be borne by the port management body of said port.
