In accordance with MEPC.1/Circ.883/Rev.1, Maritime Bureau, MLIT requires the following actions to be taken by the ship master/ship owner/ship operator when a malfunction of EGCS occurs during a sailing.
1. For Japanese flag ship
(1) As soon as possible after evidence of a malfunction, the ship should take action to remedy the malfunction; and,
(2) In case the EGCS cannot be put back into a compliant condition within one hour, the ship should take the following actions:
[1] to use compliant fuel oil
1; and,
[2]to report the following information and data to relevant District Transport Bureau
2, Ministry of Land, Infrastructure, Transport and Tourism (MLIT):
(A) the date and time the malfunction began and the duration of the malfunction;
(B) the actions taken to resolve it; and,
(C) any necessary follow-up actions.
Note 1: If the ship does not have a sufficient amount of compliant fuel oil on board for sailing to the next port of call, using non-compliant fuel oil on board for covering shortage is acceptable while reserving the amount of compliant fuel oil that would be necessary in the next port of call. In addition, if the EGCS cannot be remedied at next port of call, the ship should bunker and use compliant fuel oil for next sailing.
Note 2: when the Japanese flag ship is sailing outside Japanese territorial sea, the ship should report to Kanto District Transport Bureau, MLIT. Meanwhile, when the Japanese flag ship is sailing within Japanese territorial sea, the ship should report to the nearest District Transport Bureau, MLIT. (3) Regardless of whether the EGCS could be put back into a compliant condition or not, the ship should keep records of the following data or information in the EGCS Record Book:
[1]the data and time the malfunction began and the duration of the malfunction;
[2]the actions taken to resolve it;
[3]any necessary follow-up actions; and
[4]the sulphur content in case a malfunction of recording systems occurs.
2. For foreign flag ship (heading to Japan)
(1) As soon as possible after evidence of a malfunction, the ship should take action to remedy the malfunction; and,
(2) In case the EGCS cannot be put back into a compliant condition within one hour, the ship should take the following actions:
[1]to use compliant fuel oil
3; and,
[2]to report the following information and data to the Port State Control Office of District Transport Bureau
4 which has jurisdiction over the port or terminal:
(A) the actions based on the instructions made by flag Administration; and,
(B) the actions taken to resolve it; and,
(C) any necessary follow-up actions.
Note 3: If the ship does not have a sufficient amount of compliant fuel oil on board for sailing to the next port of call, using non-compliant fuel oil on board for covering shortage is acceptable while reserving the amount of compliant fuel oil that would be necessary in the next port of call. In addition, if the EGCS cannot be remedied at next port of call, the ship should bunker and use compliant fuel oil for next sailing.
