CALI payments (mutual insurance payments) for damages have payment limits for injury, death, residual disability, and injury resulting in death, respectively.

Damages for Missed Work Decrease in income (including use of paid leave, and domestic work) as a result of injury incurred in accident: In principle, 6,100 yen per day. The actual amount will be paid up to 19,000 yen upon proof of a further reduction in income.
Compensation for distress Compensation for emotional and physical suffering caused by traffic accidents: 4,300 yen per day will be paid, and the number of days covered will be determined within the treatment period, taking into consideration the state of the victim's injuries and the number of days of actual medical treatment.

Damages for Residual Disability:

For damages for residual disability, lost earnings, compensation for distress, etc. are paid according to the degree of disability.

Damages for Death:

Damages for death are paid as funeral expenses, lost earnings, and compensation for the victim and bereaved family members.

Funeral expenses: expenses for wake, altar, cremation, headstone, etc. (excluding grave plot, presents given in return for funeral offerings, etc.) One million yen will be paid.
Lost earnings The amount of income that the victim would have earned in the future had they not died, less their living expenses The calculation is based on income, length of time available for work, and the presence or absence of dependents.
Compensation for distress For the victim's own compensation: 4 million yen will be paid.
Compensation for distress The amount of compensation for bereaved family members depends on the number of claimants for bereaved family members' compensation (parents, spouse and children of the victim). One claimant will be paid 5.5 million yen, two claimants 6.5 million yen, three or more claimants 7.5 million yen, and if the victim has dependents, an additional 2 million yen will be added.

Note: The provisions of Damages for residual disability shall apply mutatis mutandis to damages for injuries resulting in death.

Reduction of Payments

In the following cases, the amount paid by CALI (mutual insurance) will be reduced.

  • If the victim was grossly negligent
  • If it is difficult to determine whether or not there is a causal relationship between the injury and death or residual disability

Criteria for Payment

CALI (mutual insurance) pays for personal injury to victims of automobile accidents to ensure basic compensation within certain limits of CALI (mutual insurance) payments, etc., as stipulated by government ordinance. In order to ensure prompt and fair payment of CALI payments (mutual insurance payments), etc., non-life insurance companies (mutual insurance associations) are required to make payments in accordance with the Criteria for Payment [PDF/1,900KB], which stipulate the standards for calculating the respective amounts of Damages for residual disability, residual disability, and death.
