2022 Amendments to the Act on Securing
Compensation for Automobile Accidents

Background of the Revision

Measures to support victims and prevent accidents have been implemented by managing Special Accounts for a reserve fund that utilizes investment profits from premiums as a source of funds.
Although the number of victims of automobile accidents is decreasing each year, the number of people needing assistance from the reserve fund is not.
On the other hand, low interest rates have reduced the investment income generated from the reserve fund, and the reserve fund has been continually drawn down to cover the operating expenses for victim support and accident prevention measures each fiscal year. The fund could be depleted in as little as 10 years.

  • Note: The calendar year is used for traffic fatalities (within 24 hours of the accident).
  • Note: The number of persons eligible to receive benefits for home nursing care is the number of persons certified as eligible to receive benefits for home nursing care by the National Agency for Automotive Safety and Victims' Aid (NASVA) (as of the end of the fiscal year).
  • Note: The number of persons with severe disabilities due to automobile accidents is the number of CALI (mutual insurance) payments that were approved for a grade of residual disability requiring nursing care that corresponds to Appended Table 1 of grade of residual disabilities (Enforcement Order for the Act on Securing Compensation for Automobile Accidents).

Expansion of the shared charge and its Use

Originally, the shared charge was mainly used to compensate for accidents caused by vehicles without CALI (mutual insurance) (uninsured vehicles) and for the deaths and injuries of hit-and-run victims. However, in April 2023, the Act was amended to expand the shared charge. The funds are now also used to improve support for victims, including support for nursing care and rehabilitation, and to promote accident prevention measures such as the introduction of advanced safe vehicles.

Program for the Promotion of Victim Protection, Etc.

In accordance with the revised Act on Securing Compensation for Automobile Accidents enacted in June 2022, the Program for the Promotion of Victim Protection, Etc. has been implemented as a permanent project since April of the same year. It is intended to support accident victims and prevent accidents under the CALI system. In order to efficiently implement it, the Program was prepared and published after listening to the opinions of relevant parties such as automobile user groups, accident victims' groups and academics.

Study Group on the Program for the Promotion of Victim Protection, Etc.

Based on the Plan for the Promotion of Victim Protection, Etc. (created in April 2023), MLIT established the Study Group on the Program for the Promotion of Victim Protection, Etc.. It consists of third parties such as automobile user groups, accident victims' groups, and academics. The Study Group conducts an effectiveness review of the Program for the Promotion of Victim Protection, Etc. every fiscal year to evaluate and verify its validity as a program.

MLIT has created the “Traffic Accident Victim's Notebook” with the hope of providing support to automobile accident victims. The notebook allows victims and their families to record accident details and provides information about support systems available through police, local governments, and private victim support organizations. We also hope that it will provide support to all accident victims, and help to ease their concerns.
